Pencil is designed to generate unique content for each client, reducing the risk of copyright issues. The uniqueness of the content depends on the context provided to the AI model. To ensure your ads are original:
Use Brand & Asset Libraries – Upload as much first-party (1P) data as possible. The more brand-specific context you provide, the more tailored the content will be.
Copyright Protection Measures
Pencil also has built-in safeguards to prevent copyright risks:
Prompt Filtering in AI Governance – Brands can block prompts that mention competitors, ensuring the AI doesn’t generate content referencing them.
Licensed AI Models – Users can select models trained on fully licensed data, such as Bria, or Adobe's image models, to avoid unlicensed content.
Indemnity Provisions – Pencil Pro Terms of Service include indemnity protections for added security.
Asset Lineage Tracking – Pencil automatically maps the relationships between raw source assets and the creatives built from them, giving legal and brand teams full provenance for any ad: you can trace a final ad back to its sources, or see every piece of content built from a given asset.
Asset Expiry Management – Licensing expiry dates are captured automatically from integrated DAM systems and propagate to every creative, template, or remix built from an asset. Pencil blocks expired files at selection, during workflow execution, and at export. Default rules for assets without expiry metadata can be set in the Asset Expiry tab in Workspace Settings.
By combining strong AI governance, licensed data, brand-specific inputs, and automated asset compliance, Pencil helps ensure your ad content is both unique and legally compliant.
